Terms of Use

These Terms of Use (“Terms”) govern access to and use of the Smart Learning X web application (“App”, “Service”), operated by Growth Guide (Dinesh Kumar Consulting Private Limited), India.

By accessing or using the Smart Learning X App, you agree to these Terms. If you do not agree, please do not use the App.

1. About the App

Smart Learning X is a digital interactive learning application designed for children aged 2–6 years. The App allows children to tap images, hear related sounds, and learn through play-based interaction.

This is a digital product only. No physical book, toy, or device is shipped.

2. Eligibility & Parental Responsibility

• The App must be purchased and accessed by a parent or legal guardian.
• Children should use the App under adult supervision.
• Parents are responsible for screen-time management, safe device usage, and appropriate supervision.

3. Access & License

Upon successful payment, we grant a limited, non-transferable, non-exclusive license to access the App.

Violation may result in suspension without refund.

4. Payments & Pricing

Price is displayed inclusive of GST, where applicable. Payments are processed securely through Razorpay or authorized partners. We do not store card, UPI, or bank details. Failure of payment may restrict access.

5. Digital Nature & Refund Policy

Because Smart Learning X is a digital access product:

• Access is delivered instantly after payment.
• Refunds are generally not available once access is granted.

Refunds may be considered only if payment is deducted but access not provided, a duplicate transaction occurs, or a technical issue remains unresolved. All refund decisions are final.

6. Content Ownership & Restrictions

All App content (Images, Sounds, Text, Design, Software) is the intellectual property of Growth Guide. You may not copy, download, share access publicly, use content commercially, or resell the App. Unauthorized use may lead to legal action.

7. Learning Disclaimer

Smart Learning X is an educational support tool, not a guaranteed learning outcome program. We do not promise specific IQ improvement or academic performance increase. Learning outcomes vary by child.

8. Referral / Affiliate Tracking

We may provide referral links or codes to influencers. By purchasing through such links, referral information may be recorded for commission calculation. No personal financial data is shared with influencers.

9. Service Availability

We aim for continuous availability, but temporary downtime may occur due to maintenance or server issues. We are not liable for interruptions beyond reasonable control.

10. Limitation of Liability

To the maximum extent permitted by law, Growth Guide shall not be liable for indirect damages, loss of data, device misuse, or excessive screen-time effects. Use of the App is at user discretion.

11. Privacy

Use of the App is also governed by our Privacy Policy. Please review: Privacy Policy.

12. Suspension or Termination

We may suspend or terminate access if Terms are violated, unauthorized sharing occurs, or fraudulent payment is detected. No refund will apply in such cases.

13. Changes to the App or Terms

We may update App features, modify pricing, or revise these Terms. Updates will be posted with a new date. Continued use means acceptance of changes.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of India. All disputes shall fall under the jurisdiction of courts in Uttar Pradesh, India.
